Import clearance is important for all products coming from non-EU countries to pass through customs security controls. Like exporting, the import of goods needs to comply with requirements related to the importer, the exporter and the product itself.

    What is import clearance?

    Import clearance is a set of customs procedures and controls to which goods and products are subjected when entering Spain. These products come from a country that is not part of the European Union, i.e. any goods arriving by sea, land or air from a non-EU country will have to go through import customs clearance. 

    This part, where the goods enter the country, is an important and delicate phase, as a series of formalities have to be carried out before the Customs and Excise Department of the Tax Agency. What customs does is ask for a series of data on the importer (buyer), the exporter (seller) and the merchandise purchased. 

    Depending on the type of product imported, Customs will carry out one type of control or another to see if the requirements that apply in terms of customs duties and taxes, health, safety and quality are met.

    Customs clearance circuits

    These are colour codes that indicate the status of the goods (everything is in order, there is something missing, an inspection is required, etc.). Depending on whether the goods need inspection or not, a colour is assigned:

    Green channel

    The documentation is in order and the goods can pass through without restrictions.

    Yellow channel

    There has been an absence of some documents and when all the documentation is completed, the goods are released. That is, after a non-intrusive inspection has been carried out and the relevant certificate has been issued.

    Inspection of the goods is required. The customs services are in charge of the exhaustive examination.

    Red channel

    The goods are physically and visually inspected and samples can be collected for analysis. The inspection can be carried out by Foreign Health, Plant Health, Animal Health, SOIVRE or Pharmacy.

    Documents required to import into Spain

    To import products into Spain from non-EU countries, the following documents must be presented:

    • Commercial invoice: all the basic information on the transaction appears here.
    • Customs value declaration: this is only necessary when the items being imported exceed 20,000 euros.
    • Cargo insurance: this is required when the commercial invoice does not contain the insurance information for the goods.
    • List of products: this is a commercial document containing information on the imported goods (weight, dimensions, handling instructions, etc.).
    • Transport document: this may include the Sea Bill of Lading, the FIATA Bill of Lading, the Road Waybill, the Air Waybill or the Railway Bill of Lading.
    • Single Administrative Document (SAD): this is a standard form that is presented in import declarations.
    • Customs certificates: ‘phytosanitary certificate’, ‘health certificate’, ‘SOIVRE certificate’, ‘cites’, etc.
